1. Affidavit of service filed in Court today is taken on record.

2. The petitioner seeks restoration of possession of land under Section 14(E)(3) of the West Bengal Land Reforms Act, 1955. The representation filed by the petitioner is pending consideration.

3. The Additional District Magistrate and District Land and Land Reforms Officer, Darjeeling is directed to decide the issue in accordance with law at the earliest but positively within a period of sixty days from the date of communication of this order.

4. It appears from records that the Additional District Magistrate and District Land and Land Reforms

Officer, Darjeeling has directed the Sub Divisional Officer to take a decision in the matter.

5. It is made clear that the Additional District Magistrate and District Land and Land Reforms Officer, Darjeeling shall decide the issue and not relegate the same to the Sub Divisional Officer.

6. The Sub Divisional Officer is directed to render all necessary assistance, cooperation and produce the records of the case before the Additional District Magistrate and District Land and Land Reforms Officer, Darjeeling at the time of deciding the issue.

7. An opportunity of hearing shall be given to all the necessary parties prior to final disposal of the representation of the petitioner.

8. The writ petition stands disposed of.

9. Urgent certified photocopy of this order, if applied for, be supplied to the parties upon compliance of usual legal formalities.
