Pursuant to the direction made by this Court, today Mr. Subir Kumar Saha, learned Additional Government Pleader appearing for the State and Mr. Ajay Singhal, learned advocate appearing for the respondent no.6, have made over the necessary documents certifying that, the possession of the stall/shop room measuring about 217.50 sq. ft. has been handed over to the petitioner and the petitioner has received and accepted the possession of the 217.50 sq. ft. shop room at Siliguri Principal Market Yard at Siliguri.

The document relating to handover of possession dated September 7, 2023 signed by the respondent no. 6 along with a joint inspection report dated September 7, 2023 are taken on record. Today's order shall be read along with the said previous two orders dated September 5, 2023 and September 6, 2023.

Mr. Somnath Ghoshal, learned advocate appearing through virtual mode has submitted that, a balance sum of Rs.20,000/-(Rupees twenty thousand only) due and payable by the petitioner to the Principal Market Committee shall be positively paid on or before September 12, 2023.

Upon receiving such sum from the petitioner, the Principal Market Committee shall execute the necessary agreement and/or any other instrument required to be executed in favour of the petitioner positively within a period of seven days from the date of receiving the said sum of Rs.20,000/- (Rupees twenty thousand) from the petitioner. Today also the respondent no.6, viz., Tamal Das, is present in Court to assist this Court. His assistance is appreciated by this Court. His personal presence any further relating to this matter stands dispensed with.

With the above observation and recording this writ petition, WPA 1916 of 2023 stands disposed of, without any order as to costs.
