The petitioner was serving as the Senior Audit Officer under the Defense Estate Office. 2.

The issue relates to his service benefits particularly his claim for subsistence allowance when he was suspended during his service tenure.

Learned Senior Counsel representing the respondents submits that the writ Court will not be the competent forum to decide the issue. The petitioner is required to approach the Central Administrative Tribunal.

Any issue relating to the service of an employee of the department of defense will be amenable before the Central Administrative Tribunal.

The writ petition, accordingly, cannot be entertained by this Court. The same stands dismissed. 6.

It will be open for the petitioner to approach the competent forum for relief.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
