The reply affidavits filed by the petitioner to such affidavits are also taken on record.
It appears that a Co-ordinate Bench by an order dated 6th September, 2024 allowed the petitioner to sit and appear in the First Assessment Examination which was held on September 9, 2024 as per the routine of the said examination. It further appears from the said order that the result of the petitioner was directed to be kept in a sealed
envelope with the Principal of the school until further order.
Mr. Paul, learned advocate appearing for the petitioner submits that the petitioner attended the classes and also appeared in the First Assessment Examination as well as in the Final Examination of Class VII.
The grievance of the petitioner is that the school authorities have not published the result of the First Assessment Examination as well as the Final Examination of the petitioner till date. Mr. Dhar, learned advocate appearing for the school authority submits that since the result of the First Assessment Examination was directed to be kept in sealed cover with the Principal of the school until further orders, the result of the First Assessment Examination as well as the Final Examination have been kept in a sealed cover and have not been published. Mr. Dhar seeks leave of the Court to publish such result.
The school authority is directed to publish the result of the First Assessment Examination and the Final Examination of the petitioner of Class VII by 5 p.m. today (11.04.2025).
After hearing the learned advocates for the respective parties and after going through the materials on record, this Court finds that the
principal grievance of the petitioner was that the petitioner was not being allowed to attend the school and appear at the First Assessment Examination. Since the petitioner appeared at the First Assessment Examination and Final Examination of Class VII and it has been submitted by Mr. Paul that the petitioner was allowed to attend the school, no useful purpose will be served in keeping this writ petition pending.
However, in case the petitioner is aggrieved by any future action of the school authority, it will be open to the petitioner to take appropriate steps in accordance with law.
With the above observations and directions, WPA 1946 of 2024 stands disposed of.
No order as to costs.
