In spite of service none appears for the private respondents. The State is represented by the learned Additional Advocate General.

Petitioner claims to be a lessee in respect of LR Plot No. 9, JL No. 34 within Mouza - Ranicherra Cha Bagan. The petitioner alleges that the private respondent no. 8 has encroached a portion of the said leasehold property. The petitioner claims to have submitted a representation dated July 2, 2025 before the District Magistrate and Collector, Jalpaiguri. The grievance of the petitioner is that till date no action has been taken by the said respondent.

Learned Additional Advocate General submits that some time may be given to the District Magistrate to consider the representation of the petitioner and to take action in accordance with law within the time limit that may be allowed by this court. He submits that he has not received any instruction as to whether the said representation is still pending or not.

In the light of the submissions made by the learned advocates representing respective parties, this writ petition stands disposed of by directing the District Magistrate and Collector, Jalpaiguri, being the respondent no. 2 herein, to consider the representation of the petitioner dated July 2, 2025 and to dispose of the same in accordance with law, if not already disposed of, by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorized representative, or any other person who may be affected by such decision. The entire exercise shall be completed by the 2nd respondent as early as possible, but positively within a period of eight weeks from the date of receipt of a server copy of this order.
