The State of West Bengal & Ors.

Mr. Bapi Sarkar Mr. Roumyadip Saha Mr. Prabhat Singha ....for the petitioner Mr. Pretom Das Mr. Bikash Singha ....for the State Affidavit of service filed in Court today is taken on record. The petitioner claims that his property was acquired for the purpose of construction of the National Highway. The petitioner alleges that while computing the amount of compensation the concerned authority has applied Factor 1.1.

The learned advocate appearing for the petitioner places reliance upon a notification dated February 9, 2016 issued by the Ministry of Rural Development and submits that the market value in the case of the petitioner ought to have been multiplied with the Factor 2.00 (two).

Heard the learned advocate for the State on such submission.

In the light of the submission made by the respective parties W.P.A. 1914 of 2025 stands disposed of by directing the Special Land Acquisition Officer being the respondent No.3 to consider

whether the notification dated February 9, 2016 shall apply to the case of the petitioner.

In the event, the respondent authority is of the view that the notification dated February 9, 2016 shall be applicable to the case of the petitioner, steps shall be taken by the said respondent to compute the amount of compensation that the petitioner is entitled to and the balance amount together with interest thereon in accordance with law shall be paid to the petitioner immediately thereafter.

The entire exercise shall be completed by the respondent No.3 as expeditiously as possible but positively within a period of 4 weeks from the date of receipt of a server copy of this order. Needless to mention that the State respondent authority shall afford an opportunity of hearing to the petitioner. All parties shall act with the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
