The defendant in a suit for eviction of licensee is the petitioner of the instant application under Article 227 of the Constitution of India which is directed against the order dated August 3, 2024 passed by the learned Civil Judge (Senior Division) at Darjeeling in the said suit being Title Suit No.1 of 2019.

The learned Trial Judge by the order impugned has marked two documents for identification being X-1 and X-2. The defendant contends that those documents should be impounded for not being properly stamped, an application praying for such impounding of the said two document is pending disposal.

The order impugned does not call for any interference inasmuch as the said documents are yet to be taken on record. However, the pending application for impounding is required to be decided on its merit in accordance with law. The learned Trial Judge is requested to dispose of the said application immediately, particularly keeping in view that two directions for expeditious disposal of the suit have already been passed by this Court.

CO 156 of 2024 along with the connected application being CAN 1 of 2025 is disposed of with the above direction without any order as to costs.
