The grievance of the petitioner is that the application filed by the petitioner under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 before the District Magistrate, Darjeeling on 30th September, 2020 has not been disposed of till date. The petitioner alleges that on receipt of the said application the case number has also not yet been allotted and the matter is kept pending indefinitely. The time limit for disposal of the said application has expired long back.

In view of the above, the instant writ petition is disposed of by directing the respondent No.2, the learned District Magistrate, Darjeeling to dispose of the application filed by the petitioner on 30th September, 2020 strictly in accordance with law at the earliest, but

positively within a period of four weeks from the date of communication of a copy of this order.

The petitioner is directed to forward a copy of the application which was filed in the office of the District Magistrate, Darjeeling on 30th September, 2020 at the time of communicating the order of this Court. The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
