The matter was listed on 3rd May, 2024 and on 13th May, 2024 but none appeared on behalf of the either of the parties and for the interest of justice, the case was adjourned till today.
In the order date 13th May, 2024 it was made clear that if none appears on behalf of the parties, necessary orders will be passed.
The petitioner has filed the present application under Section 482 of the Code of Criminal Procedure, 1973 praying for quashing of the criminal proceeding in CR Case No. 468 of 2019 dated 25th June, 2019 under Section 406/420 of the IPC pending before the learned Judicial Magistrate, 1st Court at Siliguri.
The petitioner has challenged the order dated 3rd September, wherein the learned Magistrate considering the complaint, statement of the witnesses and the documents has taken cognizance for the offence under Section 406/420 of the IPC and issued summons upon the petitioners.
This Court does not find any illegality in the order dated 3rd September, 2019 wherein the Magistrate has taken cognizance. Accordingly, the application filed by the petitioner does not have any merit.
Thus, CRR/218/2023 is dismissed.
