Court No.1.

AB (Rejected) CIRCUIT BENCH OF CALCUTTA HIGH COURT AT JALPAIGURI (Via Video Conference) CRM No. 1288 of 2021 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure in connection with Rajganj Police Station Case No.438 of 2021 Dated 26.10.2021 under Sections 498A/325/379/306/506 of the Indian Penal Code And In the matter of: Amjat Ali & Ors.

......Petitioners.

Mr. J. K. Bhowmick ......for the Petitioners.

Mr. Ujjwal Luksom, Mr. Tapan Bhattacharya......for the State.

The petitioners are in-laws of the victim lady, who allegedly committed suicide. The allegation is that the victim was tortured by the petitioners which drove her to kill herself. The petitioners say that they have no connection with the alleged offence. They have been falsely implicated. We have seen the material in the case diary including the statements of the minor daughter of the victim and husband of the victim recorded under Section 164 of the Code of Criminal Procedure. The material on record, prima facie, indicates involvement of the petitioners in the alleged offence. Charge sheet is yet to be submitted.

Considering the facts and circumstances of the case and the material on record, we are not inclined to extend the privilege of anticipatory bail to the petitioners. C.R.M. No. 1288 of 2021 is, accordingly, dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Aniruddha Roy, J.) (Arijit Banerjee, J.)
