The appellant is aggrieved by the order dated August 14, 2025, by which CAN 1 of 2025 was dismissed and the appellant's prayer for incorporating 'August 16, 2024' instead of 'August 20, 2024' as the date of joining the college, was rejected.

Admittedly, the appellant was recommended by the College Service Commission for the post of Principal at Ghoksadanga Birendra Mahavidyalaya. The governing body was resisting the joining of the appellant. The appellant moved the High Court and was directed to join on August 19, 2024. August 19, 2024 being a holiday, the appellant approached the Court for correction of the date. In the meantime, when the learned advocates were approaching the

Court with the prayer for correction of the date, the college authority asked the appellant to join and the appellant joined on August 16, 2024. The joining report is at page 118 of the application filed in connection with this appeal.

There appears to be a miscommunication between the appellant and the learned advocate. In any event, the fact that the appellant joined the college is no longer in dispute. The order dated August 13, 2024 passed by the learned Single Judge in WPA 1532 of 2024 is modified to the extent that the direction upon the appellant to go to the college on August 20, 2024 is no longer germane as the appellant had already joined the post on August 16, 2024 and the date of joining of the appellant will be treated as August 16, 2024.

Accordingly, the appeal and the connected application are disposed of.
