Learned counsel for the petitioner submits that victim was in consensual relationship with the petitioner and was even married. The complaint was lodged by the doctor when the victim went for medical examination.

Learned counsel for the victim states that the victim has already married the petitioner.

Learned counsel for the State has produced the case diary. 4.
Perusal of the case diary indicates that the in her statement under 164 Cr.P.C. The petitioner has indicated towards the consensual relationship and then married. The petitioner is in custody since 24th June, 2025.

Taking into account, facts and circumstances, the petitioner be released bail on furnishing a personal bond of Rs.10,000/- (Rupess Ten Thousand Only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special (POCSO) 1st Court, Siliguri, subject to the condition that the petitioner shall attend the trial regularly. 6.
Urgent Photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties upon compliance of all legal formalities.
