7.11.2022 Ks.

Circuit Bench of Calcutta High Court At Jalpaiguri WPA 2699 of 2022 Suknta Das Vs.

The State of West Bengal & Ors.

Mr. Subhasish Misra ... For the Petitioner.

Mr. Subir Kumar Saha, ld AGP, Ms. Bedashruti Bose ... For the State.

Heard learned Advocate appearing for the petitioner.

None appears on behalf of the Commissioner of School Education (S.E.), Government of West Bengal/respondent No.3 since according to the learned Advocate for the petitioner copy of the writ petition has been sent for service in course of today. This is not a normal practice and learned Advocate should know the procedure and practice for moving a writ petition in the highest court of the State. This conduct of the learned Advocate for the petitioner is not appreciated. However, in the interest of justice I am inclined to entertain this writ petition by directing the learned Advocate for the petitioner to serve a copy of the writ petition on Mr. Saha, learned Additional Government Pleader.

On perusal of the writ petition I find that the petitioner has filed a representation on 22nd January,

2021 being Annexure P-5 to the writ petition and it is the allegation of the petitioner that the same has not been considered till date with regard to the prayer of the petitioner for his transfer.

Considering the submission of the parties and facts and circumstances as appears from record, this writ petition being WPA 2699 of 2022 is disposed of by directing the respondent No.3 to consider and dispose of the aforesaid representation dated 21st January, 2021 in accordance with law and by passing a reasoned and speaking order, within eight weeks from the date of communication of this order.
