Rejected Calcutta High Court Ct.3 In the Circuit Bench at Jalpairuri C.R.M. (NDPS) 393 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Kharibari Police Station Case no. 298 of 2024 dated 27.09.2024 under Sections 21(c)/22 (c)/29 of the NDPS Act, 1985.

Petitioner Mr. Debashis Mukhopadhyay Ms. Srishti Sarkar ...for the Petitioner Mr. Kallol Acharjee Mr. Aniruddha Biswas ...for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody for about 397 days since 27.09.2024. She further submits that though the charge-sheet was submitted on 23rd March, 2025 but neither the copies have been served upon the petitioner as yet nor the charge has been framed and as such it is uncertain as to when the trial would commence and considering his period of detention he may be released on bail on any terms and conditions.

Learned counsel for the State opposed the bail prayer contending that the petitioner's bail prayer was earlier rejected by this Court on 09.06.2025 being CRM (NDPS) 172 of 2025 and there appears to be no circumstances, which can justify the renewal of his bail prayer. He further submits that

509 grams of brown sugar was recovered from the joint possession of the petitioner and other accused persons. Having heard learned counsel appearing on behalf of both the parties, I find that the petitioner has failed to overcome the restrictions imposed in Section 37 of the NDPS Act, and as such prayer for bail made by the petitioner stands rejected.

However, trial court is requested to make every endeavour for expeditious disposal of the case keeping it in mind that the petitioner's valuable fundamental right of speedy trial and to take all steps to conclude the trial preferably within a period of one year from the next date of hearing.

Both the parties are directed to communicate the order before the court below at once.

Accordingly, CRM (NDPS) 393 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
