The instant application is filed against the Order dated 10th April, 2023. This order was passed by the Learned Judicial Magistrate, 2nd Court at Siliguri.

Earlier, an application under Section 205 of Cr.P.C. was allowed but there was a delay in filing Vakalatnama for 22 days, as a result of which, adjournments had to be taken. But the Learned Court issued warrant of arrest cancelling the privilege granted under Section 205 of Cr.P.C.

The Learned Counsel submitted that Vakalatnama may forthwith be filed if permitted.

I have heard the submission of the Ld. A.P.P. representing the State.

The Order dated 10th April, 2023 is set aside. Vakalatnama shall be filed within 7 days in the Trial Court and Trial Court shall expedite hearing. Warrant of arrest is cancelled.

The instant criminal revision application stands disposed of.
