Learned counsel for the petitioner submits that no recovery has been effected from the petitioner in the testimony of coaccused. 2.
Learned counsel for the State submitted that no recovery has been effected from the present petitioner. Learned counsel submits that he was named by the co-accused from whom recovery was effected saying that these contrabands were supplied to him by the petitioner.

Thus, taking into account, the submissions of both the parties, admittedly no recovery was effected from the accused and his name only found place in the disclosure of co-accused. 4.
Therefore, the prayer of bail is considered and allowed.

Thus, taking into account the facts and circumstances of this case petitioner is admitted to bail upon furnishing a personal bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS), Alipurduar and on subject to the conditions as laid down under Section of Cr.P.C.
corresponding to Section 483 of the BNSS, 2023 and on further conditions that the petitioner shall attend the trial regularly and the petitioner shall also meet the Investigating Officer every fortnight once in a week till the investigating is completed. 6.
Accordingly, C.R.M. (NDPS) 423 of 2025 stands disposed of.

Urgent Photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties upon compliance of all legal formalities.
