The representation filed on behalf of the petitioner seeking removal of unauthorised encroachment in front of the land of the petitioner is pending consideration at the end of the PWD, North Bengal Construction Division, Siliguri.

Without entering into the merit of the allegations raised by the petitioner, the instant writ petition is disposed by directing the Executive Engineer, PWD, North Bengal Construction Division, Siliguri to consider and dispose of the legal representation filed on behalf of the petitioner in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order. 4.

A reasoned order shall be passed and communicated to the parties immediately thereafter.

If it appears that the allegation made by the petitioner is proper then necessary follow up steps shall be taken by the aforesaid authority.

Learned advocate for the petitioner is directed to forward a copy of the legal representation dated 12th June, 2024 along with a copy of the communication being Memo No. 1140 dated 19th June, 2024 and copy of the order dated 9th January, 2023 passed by the Court in WPA 2029 of 2022 (Gita Devi - Vs- The State of West Bengal & Ors.) at the time of communicating the order of the Court.

The writ petition stands disposed of.
