And In Re: Smt. Laxmi Deb @ Mrittika @ Lakshmi Deb
...Petitioner
Mr. Kunaljit Bhattacharjee, Mr. Alok Sah ...for the Petitioner Mr. Aditi Shankar Chakraborty, Ld. A.P.P., Mr. Arjun Chowdhury ...for the State Apprehending arrest in connection with Pradhan Nagar Police Station Case No.382 of 2023 dated 24th May, 2023 under Sections 406/420/120B of the Indian Penal Code, the present application has been preferred.
Mr. Bhattacharjee, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in the alleged offence. She is not a partner of the concerned company. She was employed in the same and was even not paid her salaries, as would be explicit from the documents annexed to the present application. She has thus been falsely implicated and she had no direct nexus with the alleged offence. Mr. Chowdhury, learned advocate appearing for the State opposes the petitioner's prayer and submits that the office bearers of the concerned company have duped several investors' of huge
amount of money. As the investigation is still continuing, the petitioner's prayer needs to be refused.
Having heard the learned advocates and considering the materials in the case diary, the gravity of the offence, its ramification and the extent of complicity of the petitioner in the alleged offence, we are not inclined to exercise any discretion in her favour moreso when, the investigation is still continuing. In view thereof, the petitioner's prayer for anticipatory bail is refused. The application for anticipatory bail CRM (A) 697 of 2023 is dismissed.
