Learned Advocate for the petitioner submits the the marriage between the petitioner and the victim was solemnized in the year 2011. The FIR was lodged in the year 2025. In between this period, there are no such complaints. The allegations are omnibus. The co-accused have been granted anticipatory bail by the learned Sessions Judge, Alipurduar and the prayer of the petitioner was rejected. He seeks for grant of anticipatory bail to the petitioner.

Opposition such prayer for anticipatory bail, learned Advocate for the State submits that there are specific

allegations against this petitioner of inflicting torture upon the victim which resulted in her injury. He seeks for dismissal of the application.

Perused the case diary and the materials on record. 4.

The victim in her statement recorded under Section 164 of the Cr.P.C. stated of assault by the petitioner. Be that as it may, the injury report shows mild swelling on right cheek. In view of the above, I am inclined to allow the prayer of the petitioner for anticipatory bail.

Accordingly, in the event of arrest the petitioner namely Gouranga Sarkar shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, corresponding to 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner is directed to join investigation and cooperate with the Investigating Officer. 6.

This application for anticipatory bail is, thus, allowed. 7.

CRM (A) 690 of 2025 stands disposed of.
