Sakti Prasad Paul v. State Of West Bengal And ORS.
29.09.2022 Sl. No.36(DL) srm In The High Court at Calcutta Circuit Bench at Jalpaiguri Appellate Side W.P.A. No. 2778 of 2022 Sakti Prasad Paul
Versus
The State of West Bengal & Ors.
Mr. Hillol Saha Podder ....for the Petitioner.
Mr. Raja Saha, Mr. Prantik Garai .....for the State-respondents.
The impugned order dated August 29, 2022 has been challenged. By the said order, the Officer-in-Charge, WBCADC, Balarampur Project, Coochbehar intimated the petitioner that he will be discontinued from his contractual service on and from September 29, 2022. The petitioner submits that the petitioner's contract is likely to end in February 2023 and as such, the contract cannot be prematurely terminated.
It appears that the petitioner approached the authority by filing a representation.
This Court has not gone into the merits of the claim of the petitioner, as the petitioner was engaged on a
contractual basis. There are no service rules governing such engagement.
This writ petition is disposed of with a direction upon the Officer-in-Charge, WBCADC, Balarampur Project, Coochbehar, i.e. the respondent No.5 to treat the writ petition as a representation of the petitioner and dispose of the same in accordance with law. A reasoned order shall be passed and communicated within six weeks from the date of communication of this order. There shall be no order as to costs.
Parties are to act on the basis of the server copy of this order.
