Banerjee) Mr. Sudip Guha Mr. Sandip Guha Roy Mr. Ananda Paul ... for the petitioner Mr. Subir Kumar Saha Mr. Hirak Barman ... for the State The petitioner alleges that the respondent authorities have not yet taken a decision on the prayer of the petitioner for voluntary retirement on medical ground and for release of the pensionary benefit and other benefits.

The learned advocate appearing for the respondent submits that the concerned District Inspector of Schools by a letter dated August 1, 2025 requested the petitioner to supply certain documents to enable the respondent authority to consider the prayer of the petitioner for voluntary retirement on medical ground.

Learned advocate appearing for the petitioner submits that no such communication was made by the said respondent till date.

Learned advocate appearing for the State is directed to handover a copy of the memo dated August 1, 2025 to the learned advocate appearing for the petitioner in course of this day.

In the event the petitioner submits the documents as specifically indicated in the memo dated August 1, 2025, the District Inspector of Schools (SE), Alipurduar, being the 6th respondent, shall consider the prayer of the petitioner for voluntary retirement vide application dated July 9, 2025 and dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner, the school authorities or any other interested person or their authorized representative.

The said respondent shall communicate the reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed as early as possible, but positively within a period of four weeks from the date of receipt of the documents as indicated in the memo dated August 1, 2025 along with the server copy of this order.

With the above observations and directions the writ petition stands disposed of.
