1. Appeal is at the behest of the claimant and directed against an award dated March 14, 2023 passed by the Motor Accident Claims Tribunal, Jalpaiguri under Section 166 of the Motor Vehicle Act, 1988.

2. Learned advocate appearing for the appellant submits that the Tribunal did not award any interest. Claimant is entitled to reasonable interest.

3. Learned advocate appearing for the Insurance Company submits that, there was no delay in the payment of the awarded amount and, therefore, interest should not be awarded as prayed for.

4. This Court finds from the record made available that, learned Tribunal was pleased to award interest @ 6% per annum from June 14, 2023 till payment, if the payment was not made within June 14, 2023.

5. Impugned award does not award interest from the date of the application for claim till the date of the payment. A claimant is entitled to interest from the

date of the application for claim till the date of payment.

6. In such circumstances, it would be appropriate to award interest @ 6 % from the date of the application being June 1, 2020 till the date of payment.

7. Impugned award is modified to such extent.

8. Insurance Company will deposit the amount on the modification of the award with the Registrar, Jalpaiguri Bench within six weeks from date.

9. FMA/64/2025 is disposed of accordingly.
