1. Affidavit-of-service and the supplementary affidavit filed in Court today are taken on record.

2. The petitioners seek consideration of the representation made on their behalf against the illegal construction that is being made.

3. None appears on behalf of the Mahakuma Parishad.

4. Without entering into the merits of the said application, the instant writ petition is disposed of by directing the Executive Officer of the Siliguri Mahakuma Parishad to consider and dispose of the legal representation filed on behalf of the petitioners in accordance with law, after giving a reasonable opportunity of hearing to all the necessary parties at the earliest but positively within a period of sixty days from the date of communication of this order. A

reasoned order shall be passed and communicated to all the parties.

5. It is made clear that no illegal construction ought to be permitted to be carried on by the authority.

6. Learned advocate appearing for the petitioners is directed to forward a copy of the legal representation to the aforesaid respondent at the time of communicating the order of the Court.

7. The writ petition stands disposed of.

8. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
