... For the O.P. No.2 I have considered the order dated 23rd October, 2024 passed by the learned Executive Magistrate, Alipurduar in connection with Petition No. 185 of 2024.
On an assessment of the orders so passed, I find that the learned Executive Magistrate has taken into account the very essence of Section 144 of the Code of Criminal Procedure and left it to the Civil Court for deciding the disputes. Having considered the same that the law and order situation was taken into account by the learned Executive Magistrate, I do not find any illegality in the impugned order. Accordingly no interference is called for.
Thus, CRR 368 of 2024 is dismissed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
