Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner had prayed for compassionate appointment in respect of his father's employment. His father was a Head Teacher of a school. He died on 27.07.2007 in harness. The petitioner was constrained to move a writ petition in 2012 in this regard. By an order dated 05.06.2015, this Court directed the authority to approve the case for appointment on compassionate ground as a primary teacher. In view of the same, the Chairperson, District Primary School Council, Cooch Behar by a communication dated 27.11.2015 wrote to the Commission of School Education to take necessary steps in this regard. However, no steps had been taken thereafter.

Learned counsel appearing on behalf of the State denies the allegations and submits that the prayer made by the petitioner is a belated one.

It is true that there is delay in the petitioner's prayer to act upon the communication dated 27.11.2015 of the Chairperson of the District Primary School Council, Cooch Behar. But, it is a fact that the authorities had also not acted in time.

In view of the above, let the respondent authorities consider the letter dated 27th November, 2015 in accordance with law and as expeditiously as possible and in terms of this earlier order passed by this Court preferably within six weeks from the date of communication of this order.

With these observations, the writ petition is disposed of.
