Learned counsel for the petitioner submits that petitioner's name, no recovery has been effected from the possession of the accused. Learned counsel submits that even his name has not appeared in the statement of co-accused.

Learned counsel for the State has also fairly submitted that the name of the petitioner does not find mention either in the FIR or statement of the accused. Learned counsel submits that I.O. has written the name of the petitioner in the memo of evidence and he has not found any basis. The court finds that admittedly there are no criminal antecedents, no recovery has been effected from the accused. His name also does not find place in the

statement of co-accused. The petitioner is in custody since 11th August, 2025.

Therefore, the prayer of bail is considered and allowed. 4.

Thus, taking into account the facts and circumstances of this case petitioner is admitted to bail upon furnishing a personal bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Court under NDPS Act, Cooch Behar and on subject to the conditions as laid down under Section of Cr.P.C.

corresponding to Section 483 of the BNSS, 2023 and on further conditions that the petitioner shall attend the trial regularly and the petitioner shall also meet the Investigating Officer every fortnight once in a week till the investigating is completed. 5.

Accordingly, C.R.M. (NDPS) 417 of 2025 stands disposed of.
