Case No.200 of 2025 dated 20.04.2025 under Section 20(b)(ii)(c)/21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act and corresponding to PTN No.WBCB01P0004262025 now pending before the court of the learned Additional Sessions Judge, 1st Court (NDPS), Cooch Behar.

Learned Advocate for the petitioners submit that the names of the petitioners have transpired from the statement of the co-accused, namely, Tahidul Haque. The other persons, whose names also transpired from the statement of the co-accused Tahidul Haque, have been granted anticipatory bail in CRM(A) 416 of 2025 and CRM (A) 612 of 2025. The petitioners stand on the same footing. He seeks for grant of anticipatory bail to the petitioners. 2.

Learned Advocate for the State, opposing such prayer, submits that huge quantity of contraband substances were recovered from the custody of the co-accused,

Tahidul Haque and from his statement the involvement of these petitioners is revealed. He seeks for dismissal of the application.

Perused the case diary and the materials on record. 4.

It reveals that the co-accused, Tahidul Hoque in his statement has named several persons including these petitioners. The other persons, who were named by the coaccused, Tahidul Hoque, have been granted anticipatory bail by this Hon'ble Court In CRM(A) 416 of 2025 and CRM (A) 612 of 2025. The present petitioners stand on the same footing. In view of the above, I am inclined to allow the prayer of the petitioners for anticipatory bail. 5.

Accordingly, in the event of arrest the petitioners namely Nurzamal Haque @ Nur Zamal Haque and Jalil Haque shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of BNSS.

This application for anticipatory bail is allowed. 7.

CRM (A) 721 of 2025 is, thus, disposed of.
