The petitioner has been appointed as Muslim Marriage Registrar by an order of the District Registrar, Alipurduar dated 16th January, 2024. He is aggrieved by the recommendation dated 12th July, forwarded by the District Registrar, Alipurduar in favour of the private respondent for temporary appointment as Muslim Marriage Registrar.

The petitioner apprehends that in view of the recommendation of the private respondent for appointment as temporary MMR, his appointment as MMR may be revoked or cancelled.

It appear that as on date, there is no order revoking/cancelling the order of the petitioner appointing him as MMR. In the absence of a formal order, no cause of action arises to file the writ petition.

The petitioner can act as MMR relying on his appointment letter.

The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
