Mr. Aditi Shankar Chakraborty, APP, Mr. Aniruddha Biswas ... For the State.
Petitioners approached this Court challenging the continuance of Pradhan Nagar P.S. Case No. 425/2024 dated 03.07.2024 which was registered for investigation under Sections 195A/325/354/379/506 read with Section 34 of the Indian Penal Code. However, during the pendency of the present revisional application which was filed for quashing of the FIR, the investigating agency concluded the investigation and submitted charge-sheet before the jurisdictional court. Mr. Biswas, learned advocate appearing for the State submits that charge-sheet was submitted on or about 31st August, 2024 and the said charge-sheet was submitted under Sections 195A/323/354/379/506/34 of the Indian Penal Code.
Having regard to the change of circumstances, particularly the charge-sheet having been submitted and none of the documents under Section 207 of the Code of Criminal Procedure having been enclosed along with the present revisional application, I grant liberty to the petitioners to approach the learned Trial Court with a prayer for discharge at the stage of consideration of charges and thereafter, if so advised, approach this Court. With the aforesaid observations, the revisional application being CRR 372 of 2024 is disposed of. Pending connected application is consequently disposed of.
