Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.
Perused the case diary.
It is a case where the present petitioner impersonated with the help of different ATM cards, Aadhar cards, PAN cards of different person and procured the consent of the defacto complainant/victim. The defacto complainant is not a minor. Charge sheet has been filed.
In the facts and circumstances, further custodial detention is not necessary.
Therefore, we are inclined to allow the application for bail of the present petitioner upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned CJM, Darjeeling with a further condition that the petitioner shall attend the learned trial court on each and every date.
It is further directed that the petitioner shall not intimidate the
witnesses or tamper with evidence in any manner whatsoever and shall not leave the State without prior permission of the Court and shall attend the court on each and every date.
The application for bail being CRM (DB) 374 of 2022 is, accordingly, disposed of.
The learned trial court is requested to expedite the trial preferably within a period of one year.
