Petitioner is in custody for 52 days. He prays for bail. Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record. Narcotics substance above commercial quantity was being transported in the bus. Petitioner and co-accused persons were apprehended and the consignment containing narcotics was recovered. In view of the aforesaid incriminating materials and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner at this stage. Accordingly, the prayer for bail of the petitioner is rejected.
