He applied for general transfer through Utsashree portal on 12th August, 2021 and his application was registered under ID number CX8369EZ.
The school where the petitioner is currently engaged has issued a "No Objection Certificate" for his transfer on 30th September, 2021. The application of the petitioner was forwarded to the District Inspector of Schools in October, 2021 and the District Inspector of Schools forwarded the same to the West Bengal Central School Service Commission on 7th October, 2021. The same is yet to be disposed of.
The petitioner relies upon the notification of the School Education Department, Government of West Bengal mentioning that the application ought to have been considered within a period of three weeks. Learned advocate representing the Commission submits, upon instruction that, the prayer of the
petitioner may be considered within a stipulated time period.
As it appears that the application of the petitioner seeking transfer is pending for a considerable period of time, accordingly, the writ petition is disposed of by directing the Chairman, West Bengal Central School Service Commission, being the respondent no.2 herein, to take a decision on the application filed by the petitioner seeking transfer in accordance with law at the earliest but positively within a period of four weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.
The writ petition is disposed of.
