The petitioners seek relaxation of the bail condition imposed upon them vide order passed on 27th January, 2025 restraining them from entering the district of Cooch Behar except for the purpose of attending trial in the present case and report to the Deputy Superintendent of Police, CBI, ACB, Siliguri Unit once a week until further orders. Learned counsel for the CBI submits that nothing adverse has been reported against the petitioner. However, the learned counsel apprehends that the petitioners may influence trial if they are allowed to enter the district of Cooch Behar before the case is finally disposed of. I have considered the rival submission of the parties.

Since evidence of the case is in progress, the bail condition directing the petitioner to report to the Deputy Superintendent of Police, CBI, ACB, Siliguri Unit is waived. Also, this Court is informed that most of the witnesses have been examined and only official witnesses are remaining to be examined. There is remote chance of the petitioners influencing the said witnesses.

In view thereof, the bail condition restraining the petitioners from entering the district of Cooch Behar is also waived.

The application being CRAN 1 of 2026 is disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
