Petitioner preferred the present writ petition 09.01.2025 Item No.01 kausik being aggrieved by the inaction of the police authorities particularly with regard to some of the accused persons evading the process of law.

Today a report has been submitted on behalf of the state which reflects that all the accused persons are on bail as such they have entered the case being Dinhata PS Case No. 332/2022.

Records reflect that the police authorities on conclusion of investigation submitted charge sheet on or about January, 2023 i.e. about two years have passed since then.

Report further reflects that the learned ACJM, Dinhata was pleased to fix appearance of the accused persons on 07.10.2024. However only two of the accused persons were present out of the five accused

persons and on the prayer of the defence advocate time was allowed and the next date has been fixed on 03.07.2025.

Having considered the present position of law and the limited time within which commitment is to take place, learned Magistrate is directed that in case any of the accused persons are absent on 03.07.2025, the bail so granted be cancelled on the said date. Learned Magistrate would ensure that copies are served upon the accused persons and the process of commitment is completed on the said date.

Learned Public Prosecutor would ensure that all sets of copies in respect of the accused persons are ready so that no adjournment is granted on the date so fixed i.e. 03.07.2025.

Registrar, High Court, Calcutta, Circuit Bench, Jalpaiguri would communicate this order to the learned ACJM, Dinhata for taking necessary and appropriate action on the next date so fixed. With the aforesaid observations WPA 2831 of 2022 is disposed of.

Report so submitted be kept with the record.
