The petitioner submits that despite the fact that the land in question being RS Plot No. 945 corresponding to LR Plot No. 1204/2322 of Mouza Dhupguri, District - Jalpaiguri being in the possession of the petitioner, the Dhupguri Municipality Authority has illegally trespassed the petitioner's land and is carrying out construction work.
Despite service only the State-respondents are represented. No one appears on behalf of the Dhupguri Municipality.
Considering the circumstances, this Court directs the writ petition to be considered as the representation of the petitioner by the appropriate
authority / Respondent No. 5 and dispose of with a reasoned order by six weeks from date upon giving a personal hearing to the petitioner.
Communication of the reasoned decision be made within two weeks from date to the petitioner. Accordingly WPA 2832 of 2022 stands disposed of.
All parties to act on a server copy of this order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
