The State of West Bengal & Ors.

Mr. Haider Ali Mr. Satyam Sarkar ....for the petitioner Ms. Bedashruti Bose Mr. Sandip Guha Roy ....for the State Affidavit of service filed in Court today is taken on record. The learned advocate appearing for the petitioner submits that respondent No.6 has been duly served.

In spite of service none appears for the private respondent. The petitioner alleges that in spite of an order passed by the Civil Court directing the police authorities to comply with the ad interim order of injunction passed by the Civil Court, the police authorities are not taking any steps in this matter. The learned advocate appearing for the State submits that the police authorities have issued notices upon the respective parties and appropriate prosecution case under Section 126 of the BNSS has been initiated.

Since the Civil Court has already passed an order directing the Inspector-in-Charge to comply with the order of injunction passed by the Civil Court, there is no necessity to pass further order directing implementation of the order passed by the Civil Court.

However, the police authorities are directed to maintain peace and tranquility at the locale.

With the above observation WPA 2049 of 2025 stands disposed of.
