1. Learned Advocate for the petitioner submits that there are no such specific allegation against this petitioner either in the written complaint or the statements of the witnesses recorded under Section 164 of the Cr.P.C. Out of the 12 accused persons 11 have already been granted bail. Upon completion of investigation, charge sheet has already been submitted. He seeks for anticipatory bail in favour of the petitioner.

2. Opposing such prayer for anticipatory bail, learned Advocate for the State submits that the co-accused persons also approached this Court for grant of anticipatory bail which has been turned down. There are specific allegations against this petitioner of his

involvement in the alleged offence of murder. He seeks for dismissal of the prayer for anticipatory bail.

3. Perused the case diary and materials on record.

4. Statement of the witnesses shows the involvement of the petitioner in the alleged offence of murder of the deceased. The Post mortem shows that the death was due to effect of asphyxia as a result of ante mortem hanging homicidal in manner. Considering such materials and the nature and gravity of the offence, I am not inclined to grant anticipatory bail to the petitioner.

5. Thus, the prayer for anticipatory bail is rejected.

6. CRM (A) 738 of 2025 stands dismissed.
