Ms. Madhushri Dutta ....for the petitioner Mr. Hirak Barman Mr. Bikash Singha ....for the State Affidavit of service filed in Court today is taken on record. The learned advocate appearing for the petitioner submits that the respondents have been duly served.

In spite of service none appears for the District Primary School Council.

The petitioner claims to be a land looser. He was appointed as a teacher in a primary school vide appointment letter dated January 10, 2024 and he joined the said service on January 13, 2024.

The petitioner states that the Commissioner of School Education by a letter dated May 12, 2023 directed the Chairman, Jalpaiguri District Primary School Council to give appointment in compliance with the judgment dated July 4, 2012 passed in W.P. No.6339(W) of 2006 read with the order dated February 15, 2019 in WPCRC 28(W) of 2017.

The learned advocate appearing for the petitioner submits that the respondent authorities are responsible for the delay in the appointment of the petitioner and for such reason the petitioner was deprived of the benefits for a period of about 8 months. The petitioner claims to have submitted a representation before the Chairman, Jalpaiguri District Primary School Council which was received by the Officer of the District Primary School Council on March 17, 2025.

The grievance of the petitioner is that till date no decision of such representation has been communicated to the petitioner till date.

The learned advocate appearing for the State submits that the District Primary School Council is the answering respondent. With the above observation WPA 2051 of 2025 stands disposed of by directing the Chairman, Jalpaiguri District Primary School Council being the respondent No.3 to consider the representation of the petitioner which was duly received by the Office of the District Primary School Council on March 17, 2025 and to pass a reasoned order after giving an opportunity of hearing to the petitioner or his authorised representative and communicate the reasoned order immediately thereafter. The entire exercise shall be completed as expeditiously as possible but within a period of four (4) weeks from the date of receipt of a server copy of this order along with a copy of the representation which was received by the Office of the District Primary School Council on March 17, 2025.
