1. Interim bail was granted to the petitioner by the coordinate Bench on January 7, 2026.

2. Report submitted by the State does not speak of any contravention of the conditions of order granting interim bail.

3. Learned advocate appearing for the petitioner submits that, jurisdictional police station was split up at a given point of time of creating two police stations and that both police stations are near about it. He submits that the petitioner is presently residing within the jurisdiction of Bhaktinagar

Police Station and not within the jurisdiction of New Jalpaiguri Police Station.

4. The condition of the petitioner that he is presently residing within the Bhaktinagar Police Station is not being seriously disputed either by the State or by the de facto complainant.

5. Since there is no breach of the conditions of order granting of interim bail, it would be appropriate to confirm the interim bail granted on January 7, 2026.

6. Accordingly, I direct that the petitioner shall be released on bail upon furnishing a bond of Rs.30,000/- (Rupees Thirty Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (under POCSO Act), Jalpaiguri subject to condition that the petitioner shall appear before the learned trial court on every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

7. Petitioner shall not enter into the jurisdiction of New Jalpaiguri Police Station without the permission of the learned trial Court.

8. In the event, the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court.

9. The prayer for bail of the petitioner is allowed.

10. CRM(M)/298/2025 along with IA NO: CRAN/2/2026 are disposed of.
