Allowed C.R.M.(A) 734 of 2024 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nagrakata Police Station Case No. 141 of 2023 dated 27.09.2023 under Sections 420/409 of the Indian Penal Code, 1860.
And In Re : Pradip Bhowmick ...... petitioner Mr. Sayan Banerjee Mr. Sourav Lahiri ....for the petitioner Mr. Kallol Acharjee Mr. Saikat Chatterjee ....for the State Apparently, the alleged defalcated amount was recovered. Petitioner as a cashier of a bank stands implicated in a case of cheating.
Materials in the case diary suggest that the amount claimed to be cheated was recovered and deposited in the respective bank accounts of the customers.
Police filed charge sheet.
In such circumstances, we grant anticipatory bail to the petitioner.
Considering the nature of the injury suffered in the incident, we grant anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of
Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023. The petitioner shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.
