1. Supplementary affidavit filed by the Counsel for the petitioner be taken on record.

2. Pursuant to the order dated 5th September, 2023 passed by a Co-ordinate Bench of this Court, the petitioner was granted interim protection against the arrest subject to the condition that he will co-operate in the investigation.

3. Counsel for the Public Prosecutor opposes the application for anticipatory bail.

4. The petitioner has co-operated in the investigation. The petitioner shall continue to do so.

5. Having regard to the facts of the case that the disputes between the parties are substantially civil and commercial in nature, this Court is inclined to grant anticipatory bail to the petitioner.

6. It is directed that in the event of arrest, the petitioner shall be released on bail to the satisfaction of the arresting officer upon furnishing a Bond of Rs.10,000/- with two sureties of Rs.5,000/- each, one of whom must be local.

7. This order is subject to the conditions laid down in sub-section (2) of Section 438 of the Code of Criminal Procedure.

8. The Case Diary be returned.

9. C.R.M. (A) No. 738 of 2023 is, thus, disposed of.
