This writ petition was filed challenging the inaction of the Officer-in-Charge, Record Room, Jalpaiguri District Court in transmitting the case records of a title suit to the learned Executing Court.

The Court had requested Mr. Rahman, learned Advocate for the State-respondents, to ensure that the grievance of the petitioner is redressed.

The writ petition is disposed, as it is submitted by the learned Counsel for the State-respondents that the case records of Title Suit No.112 of 2010 had been dispatched to the Court of the learned Civil Judge (Junior Division), Alipurduar, through a special messenger, last week. It is

expected that the records have already reached the learned Court below. The petitioners are at liberty to proceed before the learned Executing Court, in accordance with law. There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
