Mr. Ujjwal Luksom Ms. Namrata Das ... for the State Heard learned Advocate for the petitioner as well as learned Advocate for the State.

Learned Advocate for the petitioner submits that the present petitioner is in custody for four months whereas charge-sheet has been filed and further custodial detention is not necessary.

Per contra learned Advocate appearing on behalf of the State submitted that strong incriminating elements are there against the present petitioner as he procured false certificate to regularize and legalise his stay in India offending the Indian Citizenship Act.

Perused the case diary. The incriminating materials indicate that serious offence are there against the present petitioner. Chances to abscond cannot be ruled out.

Accordingly, the application for bail is rejected. The application being CRM (DB) 392 of 2022 is dismissed. The Trial Court is requested to consider the charge within a period of one month from date.
