1. It appears that the grievance of the petitioner was entertained by the authorities and the demarcation of the acquired area was made.

2. The Special Land Acquisition Officer, Jalpaiguri also issued a notice on June 10, 2025 asking the petitioner to appear before the authority with supporting documents. It is submitted that the petitioner did not appear before the authority.

3. Under such circumstances, the writ petition is disposed of directing the petitioner to appear before the Special Land Acquisition Officer, Jalpaiguri within a period of three weeks from date with all relevant documents in support of his contentions. If such documents are filed, the

concerned authority will hear the petitioner. The National Highway authority will consult the documents as also the demarcation report.

Thereafter a reasoned order shall be passed and communicated to the petitioner. If it is found that excess land is being occupied by the National Highway Authorities or was utilized by the National Highway Authorities, in any manner, then necessary compensation shall be assessed. If it is found that the National Highway Authorities have constructed only upon the acquired land, in that event, the finding shall be reflected in the reasoned order. The entire exercise shall be completed within a period of 10 weeks from the date of communication of this order.

4. There shall be no order as to costs.

5. Parties are directed to act on the basis of the server copy of this order.
