Petitioner is the wife of the respondent no. 4. She lodged a complaint against the 4th respondent on June 11, 2025 and it has been alleged that the police authority had not taken any effective step apart from registering an FIR. On the last occasion, i.e., on October 29, 2025, the learned advocate representing the 4th respondent submitted that an application for anticipatory bail has been filed by the 4th respondent which is pending before the
Hon'ble Single Judge and the same is expected to be taken up very soon.
When this matter is taken up for hearing today, learned advocate appearing for the 4th respondent submits that he has mentioned the matter before the concerned bench and the application has been upgraded but the business of the court did not permit the application to be heard today. He submits that the 4th respondent do not have any objection if a direction is passed to conduct fair investigation on the complaint made by the petitioner. He submits that the 4th respondent has materials in support of his contention that he was not present at the relevant point of time and he was on a duty assigned on account of visit of the Hon'ble Prime Minister of India.
Learned advocate appearing for the State submitted a report dated October 26, 2025 wherefrom it appears that the police authorities conducted multiple raids to apprehend the FIRnamed accused including the 4th respondent and the other FIR-named accused excepting the private respondent have obtained anticipatory bail from the competent court.
Heard learned advocates for the respective parties and perused the materials placed.
The application for anticipatory bail filed by the 4th respondent is pending before the Hon'ble Single Judge.
Be that as it may, both the parties want a fair investigation to be done by a competent investigating officer on the complaint which has been registered as an FIR.
Learned advocate appearing for the petitioner wants an impartial investigation to be conducted by an officer not below the rank of Inspector.
Learned advocate appearing for the private respondent also do not have any objection to such prayer.
In view thereof, the concerned Superintendent of Police, Coochbehar is directed to depute a competent investigating officer, not below the rank of Inspector for conducting investigation, and direct the present investigating officer to forthwith transfer all records pertaining the investigation in question to the investigating officer to be appointed by the Superintendent of Police pursuant to this order.
It is expected that the Investigating Officer, to be appointed by the Superintendent of Police, shall carry out the investigation in accordance with law and make an endeavour to conclude the same as expeditiously as possible.
With the above observations and directions this writ petition stands disposed of.
