REJECTED C.R.M.(A) 755 of 2024 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), corresponding to under Section 438 of the Code of Criminal Procedure, 1973 in connection with New Jalpaiguri Police Station Case No. 648 of 2024 dated 30.06.2024 under Sections 406 of the Indian Penal Code, 1860.

Learned advocate appearing for the petitioner submits that, the petitioner is in the business of acting as an intermediatery for the purpose of letting out vehicles on hire and self drive.

Learned advocate appearing for the petitioner draws the attention of the Court to the previous occasions when vehicles were arranged in that manner and there was no complaint. He submits that, the petitioner was falsely implicated. He submits

that the petitioner complied with notices under Section 41 of Cr.P.C.

Learned advocate appearing for the State submits that, the vehicle is yet to be recovered. Petitioner was seen with the vehicle in the C.C.T.V. footage at a petrol pump. The materials in the case diary suggest requirement of investigation. Role of the petitioner requires investigation. Vehicle is yet to be recovered.

In such circumstances, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail of the petitioner is rejected.

The victim is yet to be recovered.
