The petitioner is in custody for about two months and prays for bail.
Learned counsel for the petitioner submits that the petitioner intends to apply for Indian citizenship before the appropriate authority.
Learned counsel for the State opposes the prayer. Admittedly the petitioner is a citizen of Bangladesh and has entered India without a valid passport. The order of the Ministry of Home Affairs, New Delhi issued on 1st September, 2025 is not applicable insofar as the petitioner is concerned. Charge sheet has been submitted. Prosecution proposes to examine seven witnesses. In the event the petitioner is granted bail at this stage, there is ample possibility of his absconding.
In view of the above, prayer for bail is rejected at this stage. The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
The application for bail is disposed of.
