(NDPS) 430 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with NDPS Case no. 337 of 2025 arising out of Kotwali Police Station Case No. 281 of 2025 dated 18.05.2025 under Sections 20(b)(ii)(c) of the NDPS Act, 1985. And In the matter of : Sona Goswami @ Sona @ Rita Goswami & Ors. .... Petitioners.

Mr. Papai Mahammad ...for the Petitioners Mr. Nilay Chakraborty Mr. Tapan Bhattacharya ...for the State Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and in no way involved with the alleged offence. They were the passengers of a bus while police allegedly raided the bus and allegedly 53.158 Kgs. of ganja was recovered. However, nothing was recovered from the physical possession of the present petitioners and they are in custody since 19.05.2025. Learned counsel appearing on behalf of the State opposed the bail prayer contending that investigation is still in progress and during investigation from the communication records of their mobile phones it transpired that all the petitioners were well connected and there were in direct communication with each other in connection with the alleged offence. Investigation is still in progress and if at this stage

they are released on bail there is serious chance of hampering investigation and also their absconsion cannot be ruled out considering gravity of allegation and therefore investigation will be delayed.

Having heard learned counsel appearing on behalf of both the parties and that the seizure list discloses that the contraband was recovered from the possession of the present petitioners, I find that there are grounds for believing petitioners involvement with the alleged offence. Investigation is still in progress and considering the aforesaid facts and circumstances of the case, I find that the petitioners have failed to overcome the restrictions imposed in Section 37 of the NDPS Act, and as such the prayer for bail made by the petitioners stands rejected.

Accordingly, CRM (NDPS) 430 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
