Learned Advocate for the appellant submits that the suit out of which the present appeal arises, is valued at Rs.60,000/-, as such the instant appeal is required to be filed before the learned District Judge, Darjeeling but inadvertently it has been filed before this Court. He prays leave to withdraw the appeal and to take back the certified copy of the order impugned.

Leave, as prayed for, is granted.

The FAT 37 of 2025 is dismissed as withdrawn. The connected applications being CAN 1 of 2025, CAN 2 of 2025 and CAN 3 of 2025 are also dismissed accordingly. There shall be no order as to costs.

Leaned Advocate for the appellant is permitted to take back the certified copy of the impugned judgment and decree upon furnishing a photo copy thereof.
