Affidavit-of-service is taken on record.

The petitioner is aggrieved because the non-creamy layer (OBC) certificate has not yet been granted. It appears that the petitioner approached the Sub-Divisional Officer, Tufanganj, District-Cooch Behar, with a prayer for issuance of such certificate. The prayer of the petitioner is still pending.

Under such circumstances, the writ petition is disposed of with a direction upon the Sub-Divisional Officer, Tufanganj to dispose of the application of the petitioner dated October 19, 2022, in accordance with law. A hearing shall be given to the petitioner or to his learned Advocate or

an authorized representative. Any other authority, who may be acquainted with the facts and circumstances, shall also be heard. A reasoned order shall be passed and communicated to all.

The entire exercise shall be completed within a period of four weeks from the date of communication of this order. This Court has not gone into the merits of the claim of the petitioner and the issue shall be decided by the authority, independently.

A copy of the writ petition along with a server copy of this order be served upon the Sub-Divisional Officer, Tufanganj.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
